After a two-day jury trial, the jury returned a verdict in favor of Anthony McFerrin, a client represented by Partners Pete Heidepriem and Matthew Tysdal.
In March 2023, a driver rear-ended Mr. McFerrin in Sioux Falls. He suffered a back injury that required him to go to the emergency room and receive follow up care with a chiropractor. The driver who rear-ended Mr. McFerrin refused to take responsibility and minimized his back injuries.
Once the case was scheduled for a jury trial, the defense attorney filed an offer of judgment. That is essentially a document saying that if Mr. McFerrin does not get a verdict for more than the offer of judgment, he must pay the defense’s costs.
After two days of extensive testimony and vigorous arguments, the jury found in favor of Mr. McFerrin and delivered a verdict requiring the at-fault driver to pay 2.5 times more than the offer of judgment.
